1. Introduction

Welcome to Go Ask Alfie ("Alfie", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the Go Ask Alfie platform, including our website at app.goaskalfie.com.au, APIs, and any related services (collectively, the "Service").

Go Ask Alfie is operated by Alfie AI, an Australian business. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms, and "you" refers to both you individually and that organisation.

2. Description of Service

Go Ask Alfie is an AI-powered knowledge assistant designed for trade businesses. The Service allows you to upload documents such as product manuals, technical guides, and reference materials, and then ask questions that are answered using artificial intelligence based on the content of those documents.

The Service includes features such as document management, team collaboration, a shared knowledge library, and AI-powered question answering. We may update, modify, or discontinue features of the Service at any time.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.

You must be at least 18 years of age to create an account. Each account is for a single organisation, and you may invite team members to join your organisation's workspace.

4. Subscription and Billing

Access to the Service requires a paid subscription. Subscription plans, pricing, and inclusions are displayed on our website or provided upon request. All prices are quoted in Australian Dollars (AUD) and are inclusive of GST where applicable.

Payments are processed through Stripe, a third-party payment processor. By subscribing, you authorise us to charge your nominated payment method on a recurring basis in accordance with your chosen plan. You may cancel your subscription at any time, and access will continue until the end of your current billing period.

We reserve the right to change our pricing with reasonable notice. Any price changes will take effect at the start of your next billing cycle following notification.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Upload content that infringes any third party's intellectual property rights or that you do not have the right to use.
  • Use the Service to store or transmit malicious code, viruses, or harmful content.
  • Attempt to gain unauthorised access to the Service, other accounts, or our systems.
  • Use the Service in any way that could damage, disable, or impair its operation.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use automated tools to scrape, crawl, or extract data from the Service beyond its intended functionality.
  • Resell, sublicence, or redistribute access to the Service without our written consent.

6. Your Content

You retain ownership of all documents, data, and other materials you upload to the Service ("Your Content"). By uploading Your Content, you grant us a limited, non-exclusive licence to store, process, and index Your Content solely for the purpose of providing the Service to you and your organisation.

You are solely responsible for the legality, accuracy, and appropriateness of Your Content. We do not review or endorse Your Content and accept no liability for it.

Your Content is stored securely and is isolated to your organisation. It is not shared with other users or organisations, and is not used to train AI models.

7. AI-Generated Responses

The Service uses artificial intelligence (powered by third-party AI providers) to generate responses based on the documents in your knowledge base. You acknowledge and agree that:

  • AI-generated responses are provided for informational purposes only and should not be treated as professional advice (including but not limited to technical, legal, safety, or compliance advice).
  • AI-generated responses may contain errors, inaccuracies, or omissions. You are responsible for independently verifying any information before relying on it.
  • We do not guarantee the accuracy, completeness, or reliability of any AI-generated response.
  • You should always consult qualified professionals for decisions relating to safety, compliance, regulations, or any matter where incorrect information could cause harm.
  • We accept no liability for any loss, damage, or injury arising from reliance on AI-generated responses.

8. Shared Knowledge Library

The Service may include access to a shared knowledge library containing documents provided by manufacturers and industry sources. These documents are made available for reference purposes only. We do not guarantee the accuracy or currency of library content, and it remains subject to the intellectual property rights of the original publishers.

9. Intellectual Property

The Service, including its design, code, features, branding, and documentation, is owned by Alfie AI and is protected by Australian and international intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.

The name "Go Ask Alfie", the Alfie logo, and related marks are trademarks of Alfie AI. You may not use them without our prior written consent.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the Service, you consent to the practices described in our Privacy Policy.

11. Third-Party Services

The Service integrates with third-party providers for functionality including AI processing, payment processing, data storage, and email delivery. While we select our providers carefully, we are not responsible for the acts or omissions of any third-party service. Your use of third-party services may be subject to their own terms and policies.

12. Availability and Support

We endeavour to keep the Service available and operational, but we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime.

13. Limitation of Liability

To the maximum extent permitted by law (including the Australian Consumer Law), our total aggregate liability to you in connection with the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian law.

14. Indemnification

You agree to indemnify and hold harmless Alfie AI, its officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the Service, your breach of these Terms, or your violation of any law or third-party rights.

15. Termination

You may terminate your account at any time by cancelling your subscription and contacting us. We may suspend or terminate your access to the Service if you breach these Terms, fail to pay subscription fees, or if we reasonably believe your use poses a risk to the Service or other users.

Upon termination, your right to access the Service ceases immediately. We will retain Your Content for a reasonable period to allow you to export it, after which it may be permanently deleted. Provisions that by their nature should survive termination will remain in effect.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms. If you do not agree, you should discontinue use of the Service.

17. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Australia.
